Please read these terms and conditions (Terms) carefully.

We are Amplifi Capital (U.K.) Limited (we, or us, or our), and operate under the name My Community Finance. We are a company registered in England and Wales (registration number 08641995), whose registered office is at 30 Churchill Place, Canary Wharf, London E14 5EU, UK.

We are a registered credit broker, not a lender and we are authorised and regulated by the Financial Conduct Authority with FRN 718749. 

2. What are these terms?

These Terms are the rules you need to follow when using our website www.mycommunityfinance.co.uk, including its subsections and any of its microsites (Website). 

By using our Website, you accept to follow these Terms. If you don’t agree, you must not use our Website. 

Please always think very carefully before taking out a financial product, such as a loan or savings account. Before you agree to get a loan or savings account, make sure you read everything we and/or the credit union gives you. This includes all information and documents about the loan or savings account. If you're not sure about the content, ask for help from a professional or specialist. 

The information and other materials on our Website are meant for general information only. They are not intended to amount to any financial, investment or professional advice on which you should rely.   

3. Accessing our website

Access to our Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Website without notice (see below).We give no guarantee that our Website, or any content on it, will always be available or be uninterrupted. We won’t be liable if, for any reason, our Website is unavailable at any time or for any period. 

You’re responsible for making all arrangements necessary for you to access our Website. 

Subject to your compliance with these Terms, we grant you permission to use our Website, provided that:  

  • You’re only allowed to use our Website for personal use, not for any commercial or business purpose. You’re not allowed to resell or charge others for using or accessing our Website. 

  • You’re not allowed to duplicate, transfer, give access to, copy or distribute content on our Website without our prior written consent;  

  • You’re not allowed to use our Website for any unlawful, improper or illegal purpose or activity; 

  • You’re not allowed to use our Website to violate copyright, trademark, proprietary or other intellectual property rights of any member of our group or any third party;  

  • You’re not allowed to use our Website to damage our name or reputation or any third party; 

  • You’re not allowed to use our Website to impersonate any of our employees or other person or use a false name while using our Website or implying an association with us; 

  • You’re not allowed to use our Website to generate excessive amounts of internet traffic, to interfere with our network or others’ use of our Website or to engage in activities designed to or having the effect of degrading or denying service to users of our Website or others; and  

  • You will comply with these Terms and our Privacy Policy.

By using our Website, you confirm that you are over the age of 18 and are capable of understanding and following the rules in these Terms and our Privacy Policy.

4. What are the eligibility criteria?

If you meet the loan or savings product eligibility criteria listed here, you may apply for a loan or savings product via our Website,  

You can be eligible as a borrower only if you meet the criteria below:  

  • You’re an individual residing in the UK (excluding residents of Northern Ireland, Isle of Man and Channel Islands); 

  • You’re at least 18; 

  • You’ve an income over £18,000; 

  • You’ve a current account at a UK bank, building society or a credit union; and 

  • You meet the membership requirements of the relevant credit union (see ‘How Do You Become a Member of a Credit Union?’ section below). 

You can be eligible as a saver only if you meet the criteria below:  

  • You’re an individual residing in the UK (excluding residents of Northern Ireland, Isle of Man and Channel Islands); 

  • You’re at least 18; 

  • You have a current account at a UK bank, building society or a credit union; and 

  • You meet the membership requirements of the relevant credit union (see ‘How Do You Become a Member of a Credit Union?’ section below). 

5. How do you become a member of a credit union

You must become a member of the relevant credit union to get a loan or a savings product. To do so, you need to have a job or be a member of an organisation that is connected to the relevant credit union This is known as the ‘common bond criteria’. 

You need to have at least £1 in a share account with the credit union. Sometimes they may ask you to put more money, but no more than £5.  

The credit union will provide you with the loan agreement or savings account opening forms in order to open an account. 

6. The application process and the applicable fees

When you want to apply for a loan or savings account, we will carry out the following checks:

  • identity, fraud and credit checks; 

  • a credit rating for you from a credit reference agency; and 

  • anti-money laundering checks. 

As we are a broker, not a lender, we will ask the relevant credit union whether they approve your loan application. They may reject your application for any reason. If your application for a loan is approved, you’ll need to enter into a loan agreement with the relevant credit union. No money will be lent to you until you enter into a loan agreement. If you want to open a savings product, you will be directed through the application process on our Website to one of the credit unions in our network. The relevant credit union will require you to sign account opening documentation, including a savings deposit agreement. 

7. What is our responsibility to you?

We don’t give any representations, warranties, undertakings or implied conditions in respect of our Website or any content on it. We, along with any company within our corporate group or third party connected to us, exclude any liability arising under or in connection with these Terms or your use of our Website. 

We do not exclude or limit our liability to you where it would be unlawful to do so. These Terms don’t exclude or limit our liability to you for:  

  • death or personal injury resulting from our negligence; 

  • fraud or fraudulent misrepresentation; or 

  • any other liability that cannot be excluded or limited by English law. 

We won’t be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise arising out of or in connection with: 

  • these Terms; 

  • your use of or access to our Website; 

  • your inability to use our Website; or 

  • any errors or omissions in any content of our Website. 

In particular, we won’t be liable to you for any direct or indirect: 

  • economic losses (including without limitation loss of revenues, data, profits, contracts, use, opportunity, business or anticipated savings); 

  • loss of goodwill or reputation; or 

  • special or incidental loss or damage and/or loss or damage which was not reasonably foreseeable, 

suffered or incurred arising out of or in connection with your use of our Website and/or these Terms.  

Information on our Website 

Although we take all reasonable efforts to update the content on our Website, we exclude any warranties, undertakings or representations (whether express or implied) that the Website and any content on it are accurate, complete or up to date, or available for use either in the UK or in other jurisdictions. If you use our Website from other jurisdictions, it’s your responsibility to comply with local laws. 

We have no liability for losses or damages arising out of changes made to the content of our Website by unauthorised third parties.  

Your use of our Website 

Your use of and access to our Website is solely at your risk.  

We accept no liability if using this Website or downloading any content on it results in damage to your property. We give no guarantee that our Website will be secure or that you will be protected from risks associated with internet, such as loss of data, computer virus infection, spyware, malicious software, trojans and worms. We won’t be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website or to your downloading of any material posted on it, or on any website linked to it. 

You are responsible for configuring your information technology, computer programmes and platform to access our Website. You should use your own virus protection software.

Sometime our Website may contain links that take you to other websites and resources where you can find more information. Such links are provided by third parties and we don’t have any control over the contents of those websites. It is solely up to you to decide if you want to access these external websites. We aren’t responsible for their availability.  

You agree that such links cannot be interpreted as approval by us of those linked websites or information you may obtain from them.  

We won’t be responsible or liable, directly or indirectly, for 

  • the privacy practices of such websites; 

  • the content of such websites and resources, including (without limitation) any advertising, content, products, goods or other materials or services on or available from such websites;  

  • others’ use of these websites; or 

  • any loss, damage or offence caused by or in connection with your use or reliance on any content on such external websites. 

8. Changes to our website

We aim to update our Website regularly. We may change the content on our Website at any time without notice. We’ll post any changes on our Website. We’ll make sure that such changes do not negatively affect you. 

If it becomes necessary, we may suspend or withdraw access to our Website without notice.  

Sometimes information or material on our Website may be old and not true anymore. We’re not obliged to update such material or information. We don’t guarantee that our Website, or any content on it, will be free from errors or omissions (see What Is Our Responsibility to You?’ section above).

We exclude all liability and responsibility arising from any reliance placed on our Website and any of its contents.  

11. Uploading content to our website

We periodically upload our content standards to our Website. Whenever you make use of a feature that allows you to upload content to our Website, or to make contact with other users of our Website, you must comply with these content standards. 

You warrant that any such contribution will comply with those standards, and you’ll be liable to us and indemnify us for any breach of this warranty. As a consumer user, this means you’ll be responsible for any loss or damage we suffer as a result of your breach of warranty. 

Any content you upload to our Website will be considered non-confidential and non-proprietary. This means, we’ll have the right to use, copy, distribute and disclose to third parties any such content for any purpose. 

If any third party claims that any content posted or uploaded by you to our Website violates their intellectual property rights, or their right to privacy, we’ll have the right to disclose your identity to such third party. 

We won’t be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our Website. 

We have the right to remove any posting you make on our Website if, in our opinion, your post doesn’t comply with our content standards. 

The views expressed by other users on our Website don’t represent our views or values. 

12. What is your responsibility arising out of viruses, hacking and other offences?

We’ll report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by sharing your identity with them. In case of such a breach, you will lose your right to use our Website immediately. 

13. What are the rules about linking to our website?

You may link to our Website, but it should be done in a fair and legal way that doesn't damage our reputation or take advantage of it. You must not create a link to our Website that suggests any form of association, approval or endorsement from us where there isn't any. 

We have the right to withdraw linking permission without giving you a notice. The website you link to must comply with the content standards which we upload to our Website from time to time.

15. Which law applies to these terms?

The law of England and Wales applies to these Terms or their subject matter or formation (including non-contractual disputes or claims). The English courts will have exclusive jurisdiction over any dispute or claim arising from, or related to, these Terms and/or a visit to our Website. Please note that we reserve the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country. 

16. Agreement

These Terms are added to any other terms and conditions between you and Amplifi Capital (U.K.) Limited. Together, all of these terms and conditions make up the entire agreement between you and Amplifi Capital (U.K.) Limited. 

If there are any differences between these Terms and your existing terms and conditions, these Terms will prevail in respect of our Website. 

17. Changes to these terms

We’ll post any changes to these Terms on our Website, which will be binding on you. Whenever you want to use our Website, please check these rules to make sure you understand the Terms that apply at that time.
